Terms of Service

These terms are not yet final: the bracketed values below are decisions that

have not been made. They are published in draft so the terms of the service

are visible before purchase.

1. Who you are contracting with

MapIT is operated by Benjamin Hall ("Kloof Apps", "we", "us"), a sole trader (Einzelunternehmen) established in Germany, at [REGISTERED ADDRESS]. Contact: [SUPPORT EMAIL].

"We" throughout this document means that named person trading as Kloof Apps, because a contract needs a named party. A sole trader is not a separate company: your contract is with the individual named above. It is a one-person operation, and the Support page is honest about what that means for response times.

By buying or using MapIT you agree to these terms.

2. What MapIT is

MapIT provides premium map access for a Garmin Connect IQ application. The core Garmin application is free. MapIT is a paid add-on that unlocks downloadable maps on your watch.

3. Trial

New devices get a one-month free trial, once per device per service year. The trial starts when your watch first requests maps — not when you install the app.

4. What you are buying, and for how long

Read this carefully, because it is unusual.

MapIT is sold by service year, not as a rolling twelve months from your purchase date. A service year has a fixed end date that is the same for everyone, shown to you before you pay.

  • Buying in January gives you close to twelve months.
  • Buying in October gives you roughly three months, at a reduced price that reflects the shorter period.
  • Your access ends on the service year's fixed end date regardless of when you bought it.

We show you the exact end date and the exact price before you pay. If that trade is not worth it, buy at the start of the next service year instead.

We do this because our map provider costs run on a common annual cycle. Aligning everyone to one calendar is what makes a single-digit-euro price possible.

We do not guarantee that a future service year will be offered, or at what price. Each one depends on provider costs remaining viable.

5. Your licence

  • One active Garmin device per licence.
  • Up to two device transfers in any rolling twelve-month period, so you are not stranded if your watch breaks or you upgrade.
  • No account required. Your licence is tied to your watch.

Your licence is for your personal use. You may not resell it, share it, or try to circumvent its device binding.

Because there is no account, your device code is what identifies your licence. If you lose access to the watch and have not given us an email address, we may be unable to recover your licence. This is the trade-off for not requiring you to register — we recommend ticking the email box at checkout.

6. Vouchers

A voucher code grants one service year to whichever device redeems it. Codes are single-use.

Treat a code like cash: anyone holding it can redeem it. We store only a hashed form, so we cannot recover a lost code — we can void it and issue a replacement. An unredeemed voucher may carry an expiry date, shown when it is issued.

7. Payment

Payments are processed by Stripe, acting as merchant of record. Prices are shown inclusive of VAT, and the amount you see is the amount you are charged. We never receive or store your card details.

8. Your right to cancel, and why you are asked to waive it

Under EU and UK consumer law you normally have 14 days to cancel a digital purchase and get a refund.

MapIT activates immediately — that is the point of buying it. Before paying, you must tick a box confirming that you want access to start immediately and that you understand you lose the 14-day right to cancel once it does.

Ticking that box means you give up the 14-day cancellation right. You do not have to tick it, but we cannot activate your licence until you do.

The law specifically permits immediate delivery of digital content where the customer gives express consent and acknowledges losing the withdrawal right. We are required to ask you plainly, so we do.

9. Refunds

We do not offer automatic or self-service refunds.

We will refund, case by case, where you were charged twice or incorrectly, where a technical failure on our side meant you did not get what you paid for, where we are legally obliged to, or where your case is genuinely exceptional.

We generally do not refund simply because you changed your mind after using the service, given section 8.

If we refund you, your access ends when no paid entitlement remains. Maps already downloaded to your watch may keep working offline until they expire — a technical limitation we accept rather than a continuing licence.

10. What we do not promise

MapIT depends on third-party map providers and on Garmin's platform, and is maintained by one person.

  • We do not guarantee uninterrupted or error-free service.
  • Map data comes from third parties and may be incomplete or out of date.
  • MapIT is an aid to navigation, not a safety device. Do not rely on it as your only means of navigation in terrain where a failure could put you at risk. Carry a map and compass, and know how to use them.
  • Maps are not stored on your watch indefinitely. Our map provider's terms permit on-device caching only for a limited period, currently 30 days. After that, a tile must be downloaded again the next time your watch has a connection, and an area you have not opened within that period will not be available offline. This is a condition of the licence for the map data, not a choice we make, and it may change if the provider's terms change.
  • We may change map providers or styles where necessary to keep the service viable.
  • Support is best-effort. Faults are fixed as quickly as one person reasonably can, and app updates additionally depend on Garmin's review. There is no guaranteed response time or uptime commitment, and none is charged for.

What you are protected against is paying for something that does not arrive: a service year is sold only once the map data behind it is funded, access has a fixed end date rather than an open-ended subscription, and section 9 covers technical failures at our end.

11. Suspension

We may suspend or revoke a licence obtained fraudulently, shared in breach of section 5, or used to attack or abuse the service. Where we do, we will tell you why if you ask.

12. Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — including your statutory rights as a consumer, which these terms do not affect.

Subject to that, our total liability to you is limited to the amount you paid us in the twelve months before the claim.

We are not liable for indirect or consequential loss.

13. If something goes wrong

Email [SUPPORT EMAIL]. We would much rather resolve a complaint directly. EU consumers may also use the European Commission's Online Dispute Resolution platform.

14. Changes

We may update these terms. Material changes will be posted here with a new date.

Changes do not retroactively alter what you have already paid for: a service year you bought keeps the end date and terms it had when you bought it.

15. Governing law

These terms are governed by German law, and the German courts have jurisdiction. If you are a consumer resident elsewhere in the EU, this does not deprive you of the protection of your own country's mandatory consumer law.
